It is worth remembering that last February Alves was sentenced to four and a half years in prison for sexually assaulting a woman in the bathrooms of the Sutton nightclub in Barcelona in December 2022.

After more than a year of allegations, last February the Barcelona Court also sanctioned him to five additional years of probation, a restraining order against the victim for nine and a half years, and payment of compensation of $163,000.

The sentence was appealed by both Alves’s defense, which during the trial requested his acquittal, and by the Prosecutor’s Office, which wants to stiffen the sentence. The resolution of these appeals may take months, but while that happens, the former defender’s lawyer requested provisional release, which was granted after having been denied on numerous occasions throughout 2023, this time because the defense alleged that their client has already served a quarter of the sentence received.

This circumstance would enable him, in the event of a final sentence, to begin to have prison benefits.

Last week, via video conference, Alves made the formal request and assured the court that he would not flee and that he believes in justice.

Although this sentence did not convince the Public Prosecutor’s Office or the accusing partythe court accepted because it now estimated that “the passage of time” is a “mitigating factor” of previous criteria, and noted that the risk of flight “has been reduced.”

Now, after leaving, Alves must go to the Superior Court of Justice of Catalonia once a week to sign in person.
