New York court overturned Harvey Weinstein’s sentence after accusations of sexual crimes – El Diario NY

A new decision from the New York court was released this Thursday after Harvey Weinstein’s lawyers presented arguments about errors in the trial in which he was convicted in February 2020 of third-degree rape and first-degree sexual assault, and is that now everything turns in your favor because The conviction was annulled (with four votes, three of them were against).

This cancellation of the sentence has generated controversy and has reignited the debate over the treatment of sexual assault cases in the judicial system. Many women’s rights organizations have expressed concern about the message this decision could send to other potential victims of abuse.

The producer’s case has been emblematic in the context of the #MeToo movement, which has denounced and made visible sexual harassment and violence in the entertainment industry and beyond. The overturning of Weinstein’s conviction raises new challenges and questions about the path forward in the fight against sexual assault and the need for reforms in the judicial system to ensure equal justice for all victims.

Harvey has maintained his innocence at all times and has stated that all of his intimate relationships were consensual. Her case was one of the triggers for the #MeToo movement, which has led to greater scrutiny of sexual misconduct in the entertainment industry and other sectors.

The former Hollywood producer will remain behind bars because he continues to be investigated for other charges. In addition, he had received another sentence of 16 years.

What does the Harvey Weinstein ruling say?

“We conclude that the trial court wrongly admitted testimony of alleged previous uncharged sexual acts against persons other than those reporting the underlying crimes because that testimony did not serve any non-proprietary material purpose,” Judge Jenny Rivera began by saying.

The court compounded that error when it ruled that the defendant, who had no criminal record, could be questioned about those allegations, as well as numerous allegations of misconduct that portrayed the defendant in a highly prejudicial light. The synergistic effect of these errors was not harmless,” he added.
