Adapting to new generations and being more inclusive, the United States Citizenship and Immigration Services (USCIS) has announced a series of changes that they will begin to implement in the application for the citizenship United Stateswhere they will give the new option of identity of gender on Form N-400 or the naturalization process and here we tell you what it is about.

The update of the USCIS indicates that those who request this form to obtain citizenship will now be able to have a third gender option which can be found as option “X” and which is defined as “Other gender identity” and which came into force this April 1.

This is the first USCIS procedure in which this update is implemented and it is expected that this category will soon be added to other applications so that they have the option between choosing M for masculine, F for feminine or X which represents a gender neutral.

How can you select the new gender option?

It is important to note that you can request an update of data about your gender now if you have applied before April 1, otherwise, you will have to wait until the USCIS reviews the forms to be able to include the new gender.

If you submitted Form N-400 before April 1 and it is still pending, you should take the following into account:

  • If you received an RFE or interview notice: Provide a letter explaining that you are requesting to change your gender to X in response to the RFE or at the interview.
  • If you have an online account: Upload a letter and explain that you are requesting to change your gender to X. Upload the letter as new evidence for the pending request.
  • If you do not have an online account: Send an email to [email protected] and request to change your gender to X.
  • If you have a Violence Against Women Act (VAWA) matter or a T or U visa matter: Please see the Contact Us web page (VAWA, T and U filing inquiries section).
