For what reasons can my visa be withheld in the US?
One of the most frequent complaints of those affected by retentionis not understanding why Customs and Border Protection (CBP) officers took away their American visa. However, the law establishes that they have the right to know their situation in detail at all times. In general, when entering by land USAit is essential to prepare to demonstrate the potential return to your country of origin, your deep ties with it, and sufficient funds for the stay. Even if you pass those filters, an officer could arrest you or detain your visa if:
- You remained in USA for longer than allowed (it is only 30 days, or the restriction indicated at the entrance)
- You gave false information to a CBP officer
- You used the SENTRI lane without being authorized
- You committed a previous crime in the US
- You lost your American visa and did not notify the authorities
- You travel with prohibited items (weapons, explosives, drugs, sums of money greater than $10,000 dollars, etc.)
- You claimed to be a US citizen without being one
- You pretend to be someone else
- You used the tourist visa to work, buy merchandise to resell, or study
- You helped people cross illegally into the US
- You have a pending or unresolved judicial proceeding before a federal, state or local court in the US
- You enrolled your children in American schools with tourist visas
- You had a birth in the US without paying the relevant bills and/or accepted help from Medicare.
- You did not pay numerous traffic fines
- Accounts with previous deportations
What can I do if they detained me and/or want to retain my visa?
If they cancel you American visa without foundation, the first step is to insist (in the most pleasant and respectful way possible) that they explain to you what happened and why you are being deprived of your document. If this doesn’t work, use your right to remain silent and avoid signing any paper you don’t understand; then ask to speak to a supervisor to notify your country’s Consulate/Embassy. Generally, if the violation is not considered that serious, your visa is placed on hold for seven days; a period that you must take advantage of to provide sufficient proof of your innocence, and thus justify the return of your document.
Can I stay in the border area if my visa is detained?
The answer is yes, as long as your visa USA be one that explicitly gives you the opportunity to stay the usual 30 days. Additionally, you can stay in the strip if you agree not to travel more than 25 miles (40 km) north of the border. If due to any emergency you need to cross that limit, you must request to do so through the Form I-94 (Internment Permit.) This is available in all ports, and you must fill it out and deliver it personally.
